Terms of Service

The agreement between you and HeavenlyMobility when you shop with us. Clear, fair and grounded in US consumer law.

1. About this agreement

These terms govern all use of www.heavenlymobility.com and all purchases from HeavenlyMobility LLC (South Dakota Limited Liability Company, EIN 92-1842367) ("HeavenlyMobility", "we", "us"). By placing an order you accept these terms together with our Privacy Policy, Return Policy and Shipping Policy.

Nothing in these terms limits any right you have under the Federal Trade Commission Act, the Magnuson-Moss Warranty Act, the Uniform Commercial Code, South Dakota's Deceptive Trade Practices and Consumer Protection statutes (SDCL 37-24), or any other federal or state law that cannot be contractually waived. Canadian customers likewise retain every non-waivable right under their provincial consumer-protection legislation (for example Ontario's CPA and Quebec's LPC) and the Competition Act.

2. Orders and when a contract forms

An order is an offer to buy. A binding contract forms once we confirm acceptance by email and receive cleared payment. Under the federal ESIGN Act and South Dakota's UETA (SDCL 53-12), your electronic order and our confirmation form the contract — no paper signature needed. We may decline an order — for pricing errors, stock errors or suspected fraud — with a full and immediate refund of any payment taken.

Please review your confirmation carefully. If a shipping detail is wrong, contact us within 24 hours; carriers charge re-routing fees once a label is scanned.

3. Pricing and sales tax

All prices are quoted in US dollars. As is standard US practice, prices display before sales tax; the exact tax, if any, is calculated and shown before you pay. We currently collect South Dakota's 4.2% state sales tax on orders shipping to South Dakota addresses, where our business has nexus.

While we triple-check our pricing, if a genuine error occurs (a $2,395 power chair listed at $23.95, say) we will honor your right to cancel with a full refund rather than hold you to the mistaken price — and we ask the same courtesy in reverse.

4. Payment security

Card payments (Visa, Mastercard, Amex, Discover) are processed by PCI-DSS-compliant providers; we never see or store full card numbers. PayPal orders are settled through PayPal's platform, and financing is offered through Affirm subject to its own approval terms (0–30% APR depending on eligibility). Ownership of goods passes to you on receipt of full payment.

5. Shipping and risk

Shipping terms, timeframes and free-shipping thresholds are set out in our Shipping Policy. Consistent with the FTC's Mail, Internet, or Telephone Order Merchandise Rule, we ship within the timeframes we state or notify you of a delay and offer a refund. Risk passes to you on carrier delivery at the address provided. Every consignment is insured in transit — if it arrives damaged, contact us within 48 hours so we can claim, repair, replace or refund.

6. Returns and warranties

Our 30-day Return Policy applies to every order. Written warranties are as stated on each product page and, under the Magnuson-Moss Warranty Act, we make available the full terms before purchase — just ask. Written warranties sit alongside the implied warranties of merchantability under the UCC, which we do not disclaim.

In the event of conflict between these terms and a statutory right, the statute wins. Always.

7. Health and suitability disclaimer

Our team includes knowledgeable advisors, but content on this site — guides, sizing notes and recommendations — is general information, not medical advice, and does not create a clinician-patient relationship. For clinical positioning, pressure care or rehabilitation needs, please consult your physician, physical therapist or occupational therapist. Questions about Medicare coverage should be directed to Medicare.gov or your plan.

8. Limitation of liability

To the extent permitted by law, our liability for any claim arising from a purchase is limited to the purchase price of the product concerned. We do not limit liability for gross negligence, willful misconduct, personal injury caused by a defective product, or any liability that cannot lawfully be limited under applicable state or federal law.

9. Intellectual property

All content on this site — text, design, graphics, photography and the HeavenlyMobility mark — belongs to us or our licensors and may not be reproduced without written permission. Product photography and brands remain the property of their respective owners.

10. Governing law and disputes

These terms are governed by the laws of the State of South Dakota, without regard to conflict-of-law rules. We would far rather fix a problem than fight one: contact us first and we will do everything reasonable to resolve it. Unresolved disputes may be brought in the state or federal courts located in Minnehaha County, South Dakota, except where your state's consumer-protection law gives you the right to sue at home.
